Thank you for visiting and using our www.boxtale.com website (henceforth the 'Website').

The purpose of this Website is to facilitate your access to delivery services (henceforth the 'Services') by offering you shipping services adapted to your needs and at the best cost, as well as the possibility of appointing BOXTAL to arrange for the appropriate order or any other transaction to be fulfilled by the carriers of your choice (henceforth the 'Carriers').

Please read these General Terms and Conditions of Sale and Use (henceforth the 'General Terms and Conditions') before using the Website, as any consultation of the Website and use of the Shipping Services offered, in particular via the API, automatically implies acceptance of them in full, in addition to acceptance of the General Terms and Conditions of each Carrier (henceforth the 'Special Carrier Terms and Conditions') applicable to each Service. We recommend that you read and refer to them each time you visit and use the Website.

We reserve the right to refuse any User access to the Website, without notice, who does not fully comply with these General Terms and Conditions.

In order to benefit from the Services offered on the Website by the Carriers, you must provide all information necessary for identification and invoicing purposes. The User is responsible for ensuring that such information is up-to-date at all times. Said data shall be transmitted to the Carriers under the User's sole liability.

'User' means any natural person or legal entity wishing to use the Services offered by the Carriers via the Website in order to compare, book, order and/or purchase or arrange for the ordering and/or purchasing of any Service offered by the Carriers on the Website.

'Carrier' means any transport operator providing the Services offered on the Website. In particular, this term includes the postal operator, national and international integrators, urban and inter-urban courier firms, specialised express delivery firms, drop-off to drop-off delivery firms offering parcel collection from local shops and services and local and regional carriers.

I. Website Terms and Conditions of Use

A. Purpose and Scope of Application of the General Terms and Conditions

These General Terms and Conditions govern the relationship between BOXTAL and the User and apply to the Services offered by the Carriers via the Website.

These General Terms and Conditions apply to Users of the Website located in metropolitan France.

Services may only be ordered by Users who have read and clicked to accept these General Terms and Conditions in full, in addition to the Special Carrier Terms and Conditions applicable to each Service, prior to each order.

BOXTAL reserves the right to modify these General Terms and Conditions at any time, without notice, it being understood that such modifications shall not apply to orders already accepted.

All Users undertake to comply with the Special Carrier Terms and Conditions and in particular to pay all sums owed, and to accept the conditions and limitations of liability regarding the solutions offered by the Website and the Services proposed by the Carriers via the Website.

These GTC are subject to the provisions of Art. 25-II of French Act No. 2004-575 of 21 June 2004, Order No. 2005-674 of 16 June 2005 and Articles 1369-1 to 1369-2 of the French Civil Code (Code Civil), in addition to Articles L121-20-4, L121-27 and L134-2 of the French Consumer Code (Code de la Consommation) governing electronic contracts.

B. User Conduct

In order to use the Website, Users must be over the age of 18 and be legally capable of entering into a contract and using the Website in accordance with these General Terms and Conditions.

You shall be financially liable for all use of the Website both in your own name and on behalf of third parties, including children, unless you can provide proof of fraudulent use not resulting from any fault or negligence on your part.

You also warrant the truthfulness and accuracy of the information provided by yourself or by any third party using your details on this Website.

Any fraudulent use of the Website's ordering service or which breaches these General Terms and Conditions may result in our refusal, at any time and without notice, to allow access to the Services offered on the Website.

By using the Website, you undertake to respect the laws and regulations in force in France and, if applicable, in your country of residence.

As the Website is limited to either putting Users in contact with Carriers or arranging to have the Carriers fulfil your orders according to your choices and instructions, we do not monitor and have no control over the content of Carriers' offers on the Website.

You also undertake, in particular when using the Website, to:

  • respect others' private lives;
  • respect third-party intellectual property rights;
  • refrain from posting illegal messages, information or data;
  • refrain from stealing the identities of users of this website by using their passwords or by any other means;
  • refrain from preventing or impeding the operation of the website in any way whatsoever and from interfering with its integrity;
  • refrain from collecting data from and harassing other users of the website (in particular by sending unsolicited e-mails).

II. Use of the www.boxtale.com Website

The aim of the Website is to help Users select Carriers and Services offered via the Website, place orders in the name and on behalf of Users and have said orders fulfilled by the Carriers pursuant to Users' instructions.

Via the Website, the User appoints BOXTAL (the representative) to order Services in its name and on its behalf from Carriers selected by the User, after having validated these General Terms and Conditions and the applicable Special Carrier Terms and Conditions.

BOXTAL cannot guarantee the existence, truthfulness or availability of any delivery offer appearing on the Website. Said offers are transmitted to BOXTAL under Carriers' sole liability.

A certain quality of service is, however, required of the Carriers pursuant to a Quality Charter, which the User may consult on the Website. Quality control of the services is by means of comments which the User is invited to post regarding Services rendered or its experience with the Carriers.

Orders are placed by BOXTAL with the Carriers in the name and pursuant to the instructions of Users according to the following process:

  • You enter your request;
  • The Website searches for offers from listed Carriers corresponding to your request;
  • After selecting an offer, you can select one or more options, including Ad Valorem Insurance, and enter additional information, in particular regarding the sender and recipient addresses; you then validate your order after having accepted these General Terms and Conditions and the applicable Special Carrier Terms and Conditions;
  • A summary of your options and the total price of the Service(s) allows you to verify your order in detail before confirming it;
  • You thus appoint BOXTAL to place your order with the selected Carrier and arrange, in your name and according to the information provided under your sole liability, for the Carrier to fulfil your order. The contract with BOXTAL is now valid;
  • You can pay for your order securely on line or by bank transfer according to the terms set forth below;
  • Shortly after placing your order (BOXTAL undertakes to make every effort to ensure within 30 minutes) and as long as your Internet connection is working correctly, you will receive an e-mail confirming your order and instructions, along with a waybill in .pdf format.

This waybill must be securely attached to your parcel, by any means possible.

The Invoice corresponding to the Service ordered by the User from the Carrier and which it has paid includes and shows the amount of shipping processing fees corresponding to BOXTAL's commission, in addition to the shipping disbursements connected with the Service selected by the User, to be recovered.

In effect, BOXTAL pays the shipping expenses connected with Service selected by the User in the latter's name and on its behalf. These disbursements are recorded by BOXTAL in suspense accounts but constitute expenses for the User, who can deduct the amount of VAT thus paid to the Carrier via BOXTAL.

III. Modification and cancellation of an order by the User

Any cancellation or modification of an order must be formulated in writing and submitted in advance for authorisation by BOXTAL. No cancellation of an order by the User can be accepted unless submitted at least one day before the shipping date stipulated on the waybill.

If the order has been paid for via the Website by credit card or PayPal, the order will be reimbursed in full if cancelled less than 48 hours after the date and time of payment. If the order is cancelled more than 48 hours after the date and time of payment for the service, the order will be reimbursed, minus a cancellation fee and any fees charged by the chosen Carrier pursuant to the Special Terms and Conditions.

If the order has been paid by bank transfer, the order will be reimbursed minus a cancellation fee, irrespective of the cancellation date. Fees charged by the chosen Carrier pursuant to the Special Terms and Conditions may also be incurred.

The cancellation fee is set at €5, excl. tax.

No cancellation will be accepted for any order the delivery of which is already in progress.

The modification of any aspect of an order is possible subject to the Carrier's consent. Should the modification require the cancellation of the order, said cancellation shall incur the cancellation fee indicated above.

If the order has been paid from the wallet, either partially or in full, the amount paid from the wallet shall be reimbursed in accordance with the terms described above, by being credited to the Customer's account (in order words, by recharging the wallet), and may under no circumstances be reimbursed by bank transfer.

IV. Shipping and Delivery

The Shipper, as indicated on the order form, under the User's sole liability, must, according to the option selected, wait for the chosen Carrier either at his/her home or place of work or travel to the nearby location (Post Office, Carrier's agency or any other place indicated on the Website) in order to deposit his/her consignment accompanied with the waybill received by e-mail. The waybill certifies that the User has paid for the delivery service. If the Shipper does not use the waybill sent by BOXTAL, the Carrier will charge again for the service, this time directly to the Shipper.

The shipping service initially paid for via the Website will then be reimbursed, minus the cancellation fee defined in clause III above. The Invoice issued by the Carrier will be payable to the carrier; BOXTAL will be unable to intervene in any way whatsoever in order to have the invoice cancelled, which you hereby accept.

You are solely and fully responsible for ensuring that the information you provide to enable the selected Carrier to supply and fulfil the Services ordered via the Website is entered correctly and is complete, genuine and accurate.

In particular, as the User, you are solely responsible for complying with the following three rules, i.e. for ensuring:

  1. That the dimensions and weight of your consignment are genuine and up-to-date. Failing this, the Carrier may refuse to collect your consignment, at its sole discretion. Your consignment may also be blocked at the Carrier's warehouse or agency, in which case you will bear the cost of its recovery. You will subsequently be charged for any error on your part concerning the weight and/or dimensions of the parcel constituting an underestimation of its actual weight and/or dimensions, based on the Carrier's documents. On the other hand, you will not be reimbursed for any error on your part resulting in an overestimation of the weight and/or dimensions of the parcel. Finally, we reserve the right to refuse any User access to the Website, without notice, who repeatedly makes false declarations regarding the weight and dimensions of consignments.
  2. That the contents of your consignment are authorised and are properly secured within the packaging. Your consignment must be properly packed in order to ensure it may be handled and shipped without risk to its integrity but also in the interests of shipping personnel safety. 'Top/Bottom' and 'Fragile' indications on packaging are not taken into account by Carriers. If you do not comply with these packaging rules, your consignment may be blocked at the Carrier's warehouse or agency, in which case you will bear the cost of its recovery. The Carrier may also refuse to collect your consignment, at its sole discretion; the Carrier's commitment to ship a consignment does not constitute acceptance that the packaging complies with the packaging standards required for shipping. The contents of your consignment must not be prohibited. You are fully and solely liable for the nature of the substances/objects shipped (explosives, inflammable and toxic substances etc. are prohibited) and any harm to property or persons that they may cause. You must ensure that the substances/objects entrusted to the Carrier are lawful and non-hazardous, failing which they may be destroyed by the Carrier, without notice, at its sole and complete discretion.
  3. That the sender and recipient addresses are accurate and genuine. If the Carrier cannot access the addresses indicated due to a lack of information, the Carrier may consider that its transport service has been fulfilled. Your consignment will be stored in a warehouse, agency or nearby location and you shall bear the cost of its recovery.

Beware! If you select 'Business Address' for the departure or arrival address on the form on step 1 of the funnel, the address must comply with the following two conditions:

a. Availability: at least one person must be present at all times during normal office opening hours, either at reception or immediately available to hand over or receive a consignment.

b. Accessibility: the access must be easily identifiable (presence of a name plate, logo or business signage), in order to avoid any ambiguity as to the place of collection or delivery. Buildings mainly housing individuals are considered as residential addresses.

Failure to comply with these rules exposes you the risk of non-collection or non-delivery and/or having to pay a surcharge and/or having to go and collect your consignment at your cost with no reimbursement of the service initially paid for.

In the case of consignments for delivery abroad, information concerning delivery times for Services provided by Carriers includes average customs clearance times. BOXTAL may not be held liable for any additional delays due to longer customs clearance times.

In the case of a Service with guaranteed delivery time, only shipping expenses relating to the Service selected by the User shall be reimbursed by BOXTAL, pursuant to the Special Terms of the Carrier selected by the User. Shipping processing fees corresponding to BOXTAL's commission will not be reimbursed.

V. Proof of Order

You are expressly informed that except in the case of an obvious error by BOXTAL, the data you provide when using the Website and which are stored in BOXTAL's information system or that of the Carriers have evidential value with regard to orders placed.

You may be held liable if the information you enter, in particular information concerning shipping and delivery addresses, is found to be incorrect or false and prevents the Carrier from fulfilling the Delivery Service.

This computerised or electronic data stored by BOXTAL shall constitute proof. If produced as evidence by BOXTAL in any legal or other proceedings, they shall be admissible and enforceable between the parties under the same conditions and with the same evidential value as any other document drafted, received or stored in hard copy form.

Any purchase order signed by the User by a 'double click' according to the terms of these General Terms and Conditions shall constitute irrevocable acceptance, which may only be challenged within the limits provided for in these General Terms and Conditions.

A 'double click' associated with the authentication and non-repudiation procedure and with the protection of message integrity shall constitute an electronic signature. This electronic signature shall bind the parties in the same way as a handwritten signature.

VI. Right of Withdrawal

Pursuant to Article L. 121-20-4 of the French Consumer Code, no Services offered by Carriers on the Website are subject to the application of the right of withdrawal provided for in Article L. 121-20 et seq. of said Code with regard to distance selling.

The Services ordered via the Website are therefore solely subject to the cancellation and modification terms and conditions set forth in these General Terms and Conditions and/or in the applicable Special Terms and Conditions.

VII. Payment for Services Offered via the Website on Behalf of Carriers

A. Pricing

Each description of the Services offered by Carriers via the Website includes the exact services included in the price. Prices of services expressed as 'incl. tax' shall mean inclusive of all associated taxes, fees and service charges. Fees and service charges correspond to costs linked to the Services ordered by the User and borne by the Carriers, in particular indirect taxes (VAT and other, similar taxes) and other costs necessary in order to process Users' orders.

Generally speaking and unless otherwise stipulated to the contrary, any service not explicitly included in the order confirmation is not included in the price. In particular, for consignments shipped abroad, duties and taxes connected with customs clearance procedures and any fees charges by personnel in charge of customs clearance are not included in the given prices for Services. You are responsible for ensuring that the Recipient of the consignment can pay the customs duties upon its arrival, failing which delivery may be delayed or the parcel even returned, at your expense.

Prices for Services offered by the Carriers and appearing on the Website may be modified at any time, without notice, at the Carriers' request. Said modifications shall be applicable forthwith but shall not affect services already paid for.

B. Means of payment

1 - Immediate means of payment available to all customers.

Payment is accepted by bank transfer, PayPal or credit card and is made in advance, with the placing of the order:

For payment by credit card, a detailed invoice is issued by BOXTAL and payment made by the User directly to BOXTAL via the Website when the order is placed, by means of a secure payment procedure directly via the Website by supplying your credit card details.

For payment by bank transfer, payment must be made to the following account:

The order is confirmed and activated upon receipt of proof of the transfer and of the purchase order duly completed and signed.

2 - Means of payment available to customers who create a BOXTAL account.

Immediate means of payment available for customers who create a BOXTAL account. In addition to the foregoing, account holders benefit from several means of deferred payment: payment is accepted by bank transfer or direct debit. BOXTAL issues an invoice every 15 days, with each invoice being payable upon receipt. These means of payment are activated upon request to BOXTAL via the My Profile page.

For payment by direct debit, the direct debit authorisation request must be printed, duly completed and signed and sent, along with your bank details, to:

BOXTAL shall send the above documents to your bank in order to set up the direct debit. Payment by direct debit shall only be activated and confirmed upon receipt of your direct debit authorisation.

For payment by bank transfer, payment must be made to the following account:

In the event that payment is found to be defective, incomplete or inexistent through Your fault, the sale of the services shall be cancelled, you shall be liable to pay any resulting charges and civil and/or criminal action may, if necessary, be brought against you. We also reserve the right, at our entire discretion and without notice, to deactivate Your BOXTAL account.

The Invoice corresponding to the Service ordered by the User from the Carrier and which the User must pay includes and clearly shows the amount of shipping processing fees corresponding to BOXTAL's commission, in addition to the shipping disbursements connected with the Service selected by the User to be recovered.

In effect, BOXTAL pays the shipping expenses connected with Service selected by the User in the latter's name and on its behalf. These disbursements are recorded by BOXTAL in suspense accounts but constitute expenses for the User, who can deduct the amount of VAT thus paid to the Carrier via BOXTAL.

A detailed invoice is issued by BOXTAL and payment is made by the User directly to BOXTAL via the Website when the order is placed or by deferred payment using one of the means of payment described above.

Invoices issued by BOXTAL are payable in euros upon receipt. However, BOXTAL reserves the right to request payment in advance by any person unable to offer sufficient guarantees and/or who has not complied with the aforementioned payment terms with respect to previous orders over the course of the current year and/or previous years, without formal notice having been given to such effect.

BOXTAL only considers payment of the sums owed to it has having been made upon the effective receipt in its account of said sums; the ordering of a bank transfer does not constitute payment. In the case of payment by bill of exchange, the latter must be received by BOXTAL signed, accepted and domiciled within a maximum of ten days after the invoice date.

Any late payment shall render all sums owed to us immediately payable in full. It shall also give rise to the application of late payment penalties at a rate equal to three times the legal interest rate in force. Said penalties shall be owed from the day after the due date until the date of final payment. Without prejudice to our other rights, we shall also have the right to suspend the fulfilment of any shipping orders in progress. By way of a penalty clause and after sending prior, formal notice to pay by letter sent recorded delivery, BOXTAL also reserves the right to increase by 15% the total amount owed, excl. tax, in addition to the legal interest. Appointing a third party to settle payment for our services shall in no way absolve you from liability towards BOXTAL.

The opening of a BOXTAL account triggers the creation of a wallet, the initial, default balance of which zero. The wallet is supplied by credits in € solely valid for the purchase of shipping services on the Website (henceforth 'Parcel Euros'), in the context of sponsorship as described in clause X below. The wallet may be used for the full or partial payment of orders placed via the Website. In deferred payment mode, the amount of the wallet is automatically deducted from the invoice issued by BOXTAL every 15 days.

VIII. Claims

Any claims concerning the Services provided must be sent in a timely manner and no later than 2 (two) days after the date of the delivery by the chosen Carrier, by letter sent recorded delivery, to BOXTAL, 12 rue Vivienne LOT3, 75002 Paris, France, accompanied by supporting documents. BOXTAL shall transmit any claim to the Carrier, which shall be solely liable therefore. In the absence of any claim, all deliveries shall be considered as accepted without reservations and all subsequent claims shall be precluded. No claim may dispense you from paying for the service ordered.

If the User has taken out ad valorem insurance with Axa through BOXTAL, the claim shall be assessed at the sole discretion of Axa and BOXTAL may not be held liable. The User may not claim any form of compensation or damages from BOXTAL connected with its claim, including in connection with shipping fees.

Reimbursement shall only be made upon presentation of an invoice of purchase, sale or replacement (original documents) and/or the original proof of payment. Insufficient and inappropriate packaging is excluded from cover by the Axa policy.

The User may consult the online help section on the Boxtale.com website: find out more about Ad Valorem insurance. This is provided strictly for information purposes only and does not constitute any form of commitment by BOXTAL or Axa.

If the Carrier accepts a complaint, the reimbursement of shipping expenses concerning the selected Service shall be at the Carrier's sole discretion, pursuant to the Special Terms of the Carrier selected by the User. Shipping processing fees corresponding to BOXTAL's commission will not be reimbursed.

For all orders with the carrier Mondial Relay specifically:

  • A complaint process must be started with Boxtale.com directly (sav@boxtale.com) in the 72 hours following the reception of the parcel.
  • The specific reason for this complaint must be given and the following documentation must be provided:
    • A letter with the details of the date that the parcel was given to the drop off point and the date the parcel was collected from the pick up point as well as the Mondial Relay tracking number and the Boxtale.com tracking number.
    • Photos of the contents of the parcel as well as the packaging
    • Banking details for the refund process if the complaint is accepted by the carrier.
  • Files will be processed with 10 days of sending the email.

IX. Waiver or Limitation of Liability

We cannot guarantee continuity of the service offered by the Website or that it will be accessible at all times and waive all liability in this regard. We employ all means at our disposal to guarantee the reliability and confidentiality of the data presented on the Website but we cannot be held either criminally or civilly liable in the event of any breach of said confidentiality or other breach, whatever the origin thereof (technical problem, attack by a 'hacker', human error, etc.).

We cannot guarantee that the Website will be free of faults, errors or bugs or that they can be corrected, or that the Website will operate without interruption or failure, or that it will be compatible with a specific configuration or device.

Under no circumstances may we be held liable for malfunctions attributable to third party software, irrespective of whether or not it forms part of or is supplied with the Website.

Under no circumstances may we be held liable in the event of direct and/or indirect, foreseeable or unforeseeable damage resulting from use of the Website or from the total or partial impossibility to access the Website.

Although great care is taken in compiling and providing the data and offers provided by the listed Carriers, such information is provided for information purposes only.

Generally speaking, we only offer the various delivery solutions provided by and under the sole responsibility of the Carriers listed on the Website. The offers you receive are not exhaustive of all offers available from Carriers and reflect the data supplied and transmitted to BOXTAL by the listed Carriers.

Offers from Carriers presented on the Website appear under the sole liability of the Carriers, which hold us harmless from and against any claim or appeal by any physical person or legal entity that considers itself to have been injured by the publication and/or content of the offers, and/or of their fulfilment.

In the event that you place your order directly with the Carrier, the entire contract, including your choice of Services proposed by the Carriers on the Website and their fulfilment by the Carriers, shall be drawn up and entered into directly with the Carriers and under their sole liability.

In the event that your order is placed in your name and on your behalf by BOXTAL, with a Carrier that you have selected and according to your instructions, we shall make every effect to ensure that the Carrier fulfils your order under the Carrier's sole liability.

Under no circumstances may we be held liable for your choice either of Carrier or of the Service proposed by the Carrier.

Under no circumstances may we be held liable for errors in the information you send to us (your identity, that of the sender or any other information required for the fulfilment of the Service ordered), which you do so under your sole liability.

Under no circumstances may we be held liable for the non-performance or poor performance of all or part of the services provided for in the contract attributable either to you or to the unforeseeable and unavoidable actions of a third party to the service or in the case of force majeure.

Under no circumstances may we be held liable with respect to the performance of the Services offered on the Website; only the Carrier may be held liable therefor.

Under no circumstances may BOXTAL be held liable for the effective collection date (which may be different from the scheduled collection date), or for the effective delivery date and any delay. These factors shall remain under the Carrier's sole liability. If the chosen service includes a guaranteed delivery time, this time only commences from the effective collection date. In the event of a delay with respect to the scheduled collection date, the decision to reimburse the service shall be lie with the Carrier, and only the latter. BOXTAL may under no circumstances be held liable therefor.

In the event that you use a cash-on-delivery Service proposed by a Carrier on the Website, BOXTAL may not be held liable in the event that the beneficiary is unable to collect payment, whatever the cause. In particular, BOXTAL may not be held liable for non-payments or fraudulent payments by the shipment recipients.

Except in the case of a Website malfunction attributable to us, we may not be held liable for errors occurring in the course of an order, in the processing or printing of the waybill, attributable either to you or to the unforeseeable and unavoidable actions of a third party to the service or in the case of force majeure.

X. Promotional Campaigns

A. Special Offers/Promotions

BOXTAL may decide, at its sole discretion and according to terms defined by BOXTAL, to set up special and/or promotional offers concerning one or more Carriers.

Such offers may target Users who are already customers of BOXTAL, as part of loyalty programmes, or new Users.

The terms and conditions of these special/promotional offers shall be set out in a special notice describing in detail the terms of the offer and access by Users.

Any User (new or already a BOXTAL customer) who does not meet the criteria of the offer may not claim any indemnity or compensation of any kind.

B. Sponsorship

Sponsorship via the Website enables any customer with a BOXTAL account to earn Parcel Euros. Parcel Euros are credits that can be used only on the Website, solely to purchase shipping services. Parcel Euros are attributed by BOXTAL according to the rules described on the Website. Parcel Euros are valid for one year from the date they are obtained. The validity of Parcel Euros is automatically extended by one year if the BOXTAL account holder places an order via the Website using the Parcel Euros available in their wallet. BOXTAL reserves the right to modify the term of validity of Parcel Euros unilaterally, at its sole discretion.

If BOXTAL suspects fraudulent use of the sponsorship programme, or if BOXTAL blocks the use of a User's BOXTAL account, BOXTAL reserves the right to reset the balance of Parcel Euros contained in the wallet to zero, at its sole discretion, without having to give the User in question prior notice thereof.

Under no circumstances may the Parcel Euros available in a User's wallet entitle the User to a reimbursement by bank transfer.

In the context of the sponsorship programme, the sponsor is a customer with an account who has placed at least one order via the Boxtale.com website. The sponsor may offer to sponsor his/her contacts. However, under no circumstances may persons who are already customers of BOXTAL be sponsored; only new customers may be sponsored.

XI. Updates

We reserve the right to correct any errors on the Website as soon as they are brought to our attention and, in general, to modify all or part of the Website and its content, at any time and without notice. We may not be held liable in this respect.
